Regulations
for Travelers of the Nadzalewowej Kolei Drezynowej Sp. z o.o.
- The seller of draisine tickets is Nadzalewowa Kolej Drezynowa Spółka z ograniczoną odpowiedzialnością with registered office at Zbigniewa Romaszewskiego st. 6 lok. - A ticket for the ride can be purchased via the booking system on the website https://nadzalewowa.bookero.pl or directly from the staff 10 minutes before the scheduled departure of the draisine.
- Purchasing a ticket through the booking system involves selecting a route, day and time of travel. There are tickets available for various travel routes within the operated services. Payment for the ticket is made through an external online payment system - Przelewy24. If no payment is made for 20 minutes, the booking and ticket purchase is cancelled automatically.
- Once payment has been made, the ticket is sent by email to the email address provided no later than 30 minutes after payment.
- The fulfilment of the draisine ride takes place on the basis of a purchased ticket.
- Each Traveller must have a valid ticket for the journey. Electronic or paper tickets are acceptable.
- The traveller is obliged to arrive at the departure point 15 minutes before the scheduled departure of the draisine.
- If the traveller fails to appear for the journey, the paid ticket will be forfeited.
- The entire ride lasts between 60 min and 140 min, depending on the route chosen.
- The journey is considered to have started when the Traveller has stepped onto the platform to take a seat on the draisine.
- The passenger shall be obliged:
- Check that it has the correct ticket;
- Keep the ticket during the entire journey until leaving the railway premises, show and hand it in when requested by the staff of the draisine;
- Observe the regulations and instructions of the draisine staff.
- The use of the draisine is possible during the opening hours of the facility (9:00 a.m. to 9:00 p.m.) and on the basis of a purchased ticket. The operator reserves the right to change the operating hours of the draisine railway.
- Each draisine can carry:
- 4 adults or
- 2 adults and 3 children or
- 3 adults and 2 children or
- 4 adults and 1 child.
The traveller can ask the railway staff for an additional child seat (up to 4 years of age) fitted between the persons driving the draisine.
- The number of child seats is limited. Seat allocation is determined by the order of booking. It is the responsibility of the child's carers to ensure that the child is safe during the ride and that the seat belt is correctly fastened in the child's seat.
- Railway staff ride along with the travellers in the first and last draisine.
- Access to the draisine is only possible in designated areas. Passengers can only get on and off the draisine in the designated areas and thereby comply with the rules according to which the draisine railway operates.
- A draisine column may be stopped in transit due to breakdowns or bad weather conditions.
- Once the draisine has stopped, it is forbidden to get off it arbitrarily and you must wait for instructions from the staff.
- Each Traveller is obliged to exercise the necessary care to protect his/her own life and health and that of others. In particular, a sufficiently safe distance between the draisines must be maintained to ensure collision-free stopping. The estimated stopping distances of the draisine are for speeds of 5 km/h - 7 m, 10 km/h - 12 m and 15 km/h - 20 m respectively. Sudden stopping of the draisine should be avoided.
- The passenger is entitled to carry hand luggage weighing up to 5 kg free of charge.
- Hand luggage should be kept in direct contact while driving.
- At all times during the journey, Passengers are under the supervision of the draisine crew leader and are obliged to follow his instructions.
- Persons under the age of 18 must be supervised by an adult.
- Persons with disabilities may only use the railway if assisted by a carer.
- Children under 130 cm in height may only be transported in the rear seat (bench) when supervised by an adult who will provide appropriate care.
- Only sober persons and/or persons not under the influence of other intoxicants are allowed to take part in the ride. The consumption of alcoholic beverages and other intoxicants is strictly prohibited during the journey. In the event of resistance or hindrance to the carriage, the Carrier reserves the right to notify the police and charge the cost of cancelling the journey to such a person.
- It is forbidden to bring objects that endanger the safety of others.
- Smoking of tobacco products, e-cigarettes, etc. is prohibited during the ride.
- Standing on the draisine is not allowed during the ride. Each person must have a seat.
- While riding, it is forbidden: to lean, to catch with hands or other objects passing objects (e.g. branches, railway infrastructure) and to open the child seat.
- All loose items of clothing should be secured to prevent them from getting into the moving parts of the draisine.
- Animals may travel on the draisine. It is the passenger's sole responsibility to secure the animal for the duration of the journey, while preventing it from jumping off the draisine and impeding the movement of other draisine. The passenger shall be liable for any damage resulting from failure to comply with the above obligations.
- It is forbidden to throw away any objects while riding the roller-coaster.
- In emergency situations, Travellers will be able to signal the need for emergency braking by raising their hand.
- The traveller is obliged to leave the drop-off area as quickly as possible.
- Any technical faults on the draisine must be reported to the draisine staff immediately.
- The Carrier or its representatives may refuse to continue further travel to Travellers who do not comply with these Rules.
- The carrier reserves the right to make changes to the regulations.
- The carrier reserves the right to make changes to the timetable.
- In the event of unfavourable weather conditions making it impossible to travel on the draisine (e.g. rain, snow, hail, strong wind), the Carrier reserves the right to cancel a given course 30 minutes before its start. The passenger is entitled to re-book the course at the earliest possible date or may apply for a refund of the ticket purchase.
- A passenger who has purchased a ticket and whose fare has been cancelled by the Carrier is entitled to re-book and take the fare at the earliest possible date.
- The carrier is not responsible for a change in the weather during the course, wet and splashed clothes and a decrease in the condition of the travellers.
- The traveller is obliged to follow the regulations and instructions of the staff as well as the information along the route.
- The ticket purchased is a one-off and valid for the current tourist season.
- It is the passenger's absolute responsibility to inform the staff of any hazards or violations of these regulations by other travellers.
- The purchase of a ticket is tantamount to acceptance of these regulations.
- Pursuant to Article 3 of the Consumer Rights Act of 30 May 2014, the provisions of the Act do not apply to contracts for the carriage of passengers.
- Complaints about the service provided (a ride on a draisine) can be sent by e-mail to office@nadzalewowa.pl and will be processed within 30 working days.
- The person using the services of the Carrier consents to the processing of personal data by the Carrier in accordance with relevant regulations for the sole purpose of providing the services and goods, including in particular the RODO and the rules of data processing provided for therein. The administrator of the data, including personal data, is Nadzalewowa Kolej Drezynowa Sp. z o. o. Personal data shall be processed only and exclusively for the purpose of ensuring proper performance of the services and goods of the Carrier, fulfilment of the obligations set out in the law. Data will not be made available to entities other than those authorised by law, nor to third countries. - By purchasing a ticket, persons using the services and goods of the Carrier (and persons under their care), according to Article 81(1) of the Act on Copyright and Related Rights of 4 February 1994 (Journal of Laws 2021, item 1062, as amended), agree to the free use of their personal data in the form of their image by Nadzalewowa Kolej Drezynowa Sp. z o.o., with registered office in Warsaw, in materials published by the company (including newspapers and boards, website and social media) for promotional (marketing) activities. Consent includes reproduction of the image with all currently available techniques and methods, dissemination and publication, also together with images of other persons recorded in the course of provision of services and goods. The consent is not limited in time or territory. Consent for the processing and dissemination of the image is voluntary, however, in case of refusal, the Carrier will not be able to provide the service.
